Condizioni d’uso
App Battuta · ultimo aggiornamento: 16/10/2026
Queste condizioni regolano l’uso dell’app Battuta e dell’abbonamento Concerto. Usando l’app le accetti. Se non sei d’accordo, non usarla.
1. Chi siamo
Manuela Campoli, ditta individuale — P.IVA IT10536901001
Via Eraclito 9, 00041 Albano Laziale (RM), Italia
Email: battuta.campoli@gmail.com
- Battuta (gratis): metronomo e accordatore.
4. Abbonamento Concerto
Titolo: Battuta Concerto
Durata e prezzo: mensile 2,99 €/mese oppure annuale 24,99 €/anno
7. I tuoi contenuti
Possiamo aggiornare e migliorare Battuta.
11. Modifiche a queste condizioni

Terms of Use
Battuta app · last updated: 16 October 2026
These terms govern the use of the Battuta app and of the Gig subscription. By using the app you accept them. If you do not agree, please do not use it.
1. Who we are
Manuela Campoli, sole proprietorship — VAT no. IT10536901001
Via Eraclito 9, 00041 Albano Laziale (RM), Italy
Email: battuta.campoli@gmail.com
2. What Battuta is
Battuta is a tool for musicians: a stage metronome, a drum tuner and a “Gig” screen to prepare and play your setlists. It comes in two tiers:
- Battuta (free): metronome and tuner.
- Gig (paid): adds the Gig screen with setlists, synced to your account.
3. Account
- The metronome and tuner work without an account. An account (username, valid email and password; open sign-up) is needed for Gig and for syncing between phones; the subscription can also be purchased without an account.
- You are responsible for keeping your password confidential and for what happens on your account. If you think someone knows it, change it and let us know.
- Minimum age: you must be at least 16 to create an account; in Italy, and in other countries where the law allows it, the minimum age is 14 (Art. 2-quinquies of the Italian Privacy Code). If you are under 18, you may activate the Gig subscription only with the consent of a parent or legal guardian. Details in section 8 of the privacy policy.
- You can delete your account at any time: in the app, person menu → “Delete my account…”, or by following the instructions on the Support page. Deleting your account does not cancel the subscription (see section 4).
- Suspension or closure by us: we may suspend or close your account only if you seriously breach these terms, use the app for unlawful purposes, endanger the service or other users, or are required to do so by law or by an authority. Before doing so we will email you explaining why and, where the breach can be remedied, give you at least 14 days to put things right or to reply. We act immediately, without notice, only when needed to stop ongoing harm (for example an attack on our servers or clearly unlawful content): in that case too we will explain why afterwards, and you can challenge the decision by writing to us. If we close your account and you had not breached anything, we will refund the part of the subscription already paid and not used (see section 4, “Refunds”). In any case, for 30 days after closure you can ask us, free of charge, for a copy of your setlists in a machine-readable format. Closing the account does not stop renewals on the store: in our notice we will remind you how to cancel the subscription.
4. Gig subscription
Title: Battuta Gig
Length and price: monthly €2.99/month or yearly €24.99/year
Free trial: 7 days, then charged automatically unless you cancel at least 24 hours before the trial ends
Renewal: automatic, at the end of each period, at the same price (for price changes see below)
- Prices shown are for Italy and include VAT. In other countries price, currency and taxes may differ: the price shown by the store before purchase applies.
- The subscription can be bought only through the Apple App Store or Google Play. Payment is charged to your Apple ID or Google account at confirmation of purchase.
- The subscription renews automatically for another period of the same length unless you cancel it at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the end of the current period.
- How to cancel: in your store account settings (iPhone: Settings → your name → Subscriptions; Android: Google Play → profile icon → Payments & subscriptions → Subscriptions). Cancellation takes effect at the end of the period already paid: until then Gig stays active. Uninstalling the app or deleting your account does not cancel the subscription.
- 7-day free trial: both the monthly and the yearly plan start with 7 free days. Unless you cancel at least 24 hours before the end of the trial, at the end of the 7 days you are charged for the chosen period and the subscription then renews automatically. Any unused portion of the free trial is forfeited if you purchase a subscription before it ends. The trial is offered under the store’s rules (normally once per store account).
- Price changes: the price of a period you have already paid for never changes. We may change the price of future renewals: if so, we will notify you, through the store or by email, at least 30 days before the renewal it applies to. If the price goes up, the new price applies only if you accept it; if you do not, the subscription ends when the current period expires, with no further charges and no penalties.
- Refunds: payments are collected by the store. You can ask the store for a refund directly (Apple: reportaproblem.apple.com; Google Play: from the order history of your Google Play account) or write to us: we will not send you elsewhere and, if the store refuses a refund you believe you are entitled to, write to us and we will look into it ourselves. Where these terms provide that we refund you (sections 3, 5, 9 and 11), we route the refund through the store when possible; otherwise we refund you directly, by bank transfer or another method agreed with you, at no cost to you. For the 14-day right of withdrawal see section 5.
- Restore purchases: if you change phone or reinstall the app, use “Restore purchases” in the app’s Gig window, with the same store account.
5. Right of withdrawal (consumers)
If you are a consumer (you use Battuta for purposes outside your trade or profession), you may withdraw from the Gig subscription within 14 days of the conclusion of the contract, that is from the day you confirm the subscription on the store, without giving any reason and at no cost.
- How to withdraw: just tell us your decision clearly before the 14 days expire, by writing to battuta.campoli@gmail.com. You may use the model withdrawal form at the bottom of this page, but it is not mandatory. Alternatively you can ask the store for a refund directly, which is often the quickest route because the store collected the payment. Withdrawing by writing to us does not by itself stop renewals on the store: please also cancel in the store settings (see section 4).
- Refund: if the withdrawal is valid, we will give you back everything you paid for the subscription within 14 days of the day you told us you were withdrawing: through the store when possible, otherwise directly (see section 4, “Refunds”), at no cost to you.
- When the right is lost: for digital content supplied immediately and not on a tangible medium, the law provides that the right of withdrawal is lost once supply has begun, but only if, before the purchase, you gave your express consent to immediate supply, acknowledged that you thereby lose your right of withdrawal and received confirmation of this on a durable medium (Art. 59(1)(o) of the Italian Consumer Code). If even one of these conditions is missing, the right of withdrawal remains valid for the full 14 days.
- Free trial: you pay nothing during the 7-day trial. If you cancel on the store at least 24 hours before the trial ends, you are not charged anything and there is no need to withdraw.
- Purchase confirmation: after the purchase the store emails you a receipt. These terms, with all the information on the subscription, remain available at this address: we suggest you save a copy (for example as a PDF).
6. App Store and Google Play
These terms are an agreement between you and us: Apple and Google are not parties to it. We, and not Apple or Google, are solely responsible for the app and its content, support, maintenance, warranties and any complaint concerning the app: for any issue, contact us.
If you downloaded Battuta from the App Store (iPhone and iPad)
- Your use of the app is also governed by Apple’s Standard Licensed Application End User License Agreement (EULA): www.apple.com/legal/internet-services/itunes/dev/stdeula/. These terms supplement the EULA; in case of conflict, Apple’s EULA prevails as regards your relationship with Apple.
- You may use the app on Apple-branded devices that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions.
- Apple has no obligation whatsoever to provide any maintenance or support services for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, paid for the app; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Any other claim relating to a failure to conform is our responsibility, and your statutory rights against us are unaffected (section 10).
- We, and not Apple, are responsible for addressing any claims by you or any third party relating to the app or your use of it, including product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
- If a third party claims that the app, or your possession and use of it, infringes their intellectual property rights, we, and not Apple, will be responsible for the investigation, defence, settlement and discharge of that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo, or designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- When using the app you must also comply with any third-party terms that apply to you (for example your mobile carrier agreement).
- Apple and its subsidiaries are third-party beneficiaries of these terms: once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.
If you downloaded it from Google Play
The Google Play Terms of Service also apply. Google is not a party to these terms and is not responsible for the app: support, maintenance and complaints are our responsibility.
7. Your content
- In the app you enter your own content (song titles, setlists, tempos, notes). It remains yours: you only allow us to store and sync it to provide the service.
- Battuta does not distribute music or sheet music. You must not upload or share content you do not have the rights to, or content that is illegal or offensive.
- You are responsible for what you enter. If illegal content is reported to us, we may remove it.
8. Fair use
You must not: try to access other people’s accounts or our servers, bypass subscription checks, copy or resell the app, use it for unlawful purposes or in a way that overloads the service.
The app, the name “Battuta”, its design and code belong to the owner or its licensors. We grant you a personal, non-exclusive, non-transferable licence to use it.
9. Service availability
The metronome, tuner and already-downloaded setlists also work offline. Sync, sign-in and subscription checks need internet. We do our best to keep everything running, but the service may be interrupted (maintenance, faults, network or device problems).
We may update and improve Battuta. We may also change or remove features of the paid tier, but only for a valid reason: to comply with a new law or with a rule of Apple or Google, for security reasons, or because a feature is no longer technically sustainable. In these cases we will not charge you anything extra and we will notify you in the app or by email at least 30 days in advance; if the change is urgently required by law, by Apple or Google or for security reasons, we will notify you as soon as possible.
If the change makes your use of the subscription worse in a way that is not minor, you may cancel the subscription within 30 days of the notice (or of the change, if later) and we will refund the part of the period already paid and not used (see section 4, “Refunds”).
10. What we are liable for, and what not
Battuta is a support tool: before a gig, always check that your phone, battery, volume and connections work, and have a plan B. We recommend saving a copy of your setlists from time to time (person menu → “Download my data…”).
If you are a consumer, we are liable for damage we cause you under the applicable law: these terms do not limit or exclude our liability. Your rights remain fully valid, including the legal guarantee of conformity for digital content and services under the Italian Consumer Code (Arts. 135-octies et seq., introduced by Legislative Decree 170/2021), for the whole duration of the subscription.
If you are not a consumer (you use Battuta for your business, for example a music school or an audio rental company): except in cases of wilful misconduct or gross negligence and except for personal injury, our total liability to you is limited to what you paid for the subscription in the 12 months before the event, and we are not liable for loss of profits, loss of business opportunities or indirect damage.
In any case we are not liable for what does not depend on us and we could not reasonably have avoided: faults or settings of your phone, a flat battery, operating system updates, lack of network, the venue’s sound system, outages of Apple or Google services.
11. Changes to these terms
We may update these terms for a valid reason: new features, changes in the law or in Apple’s and Google’s rules, security, clarifications of the text. The date at the top shows the version in force.
For significant changes we will notify you in the app or by email at least 30 days before they take effect, explaining what changes; if a change is required by law or by Apple or Google within a shorter time, we will notify you as soon as possible. If you do not accept the changes, you may cancel the subscription before the new terms take effect: we will refund the part of the period already paid and not used (see section 4, “Refunds”) and the new terms will not apply to you. If you have no subscription, you can simply stop using the app and delete your account.
Purely formal corrections (typos, links, contact details) apply from publication. We keep previous versions: if you ask, we will send them to you.
12. Governing law and jurisdiction
These terms are governed by Italian law. If you are a consumer, the mandatory protections of the country where you live still apply, and any dispute falls under the courts of your place of residence. If you are not a consumer, the Court of Velletri (Italy) has jurisdiction.
Before going to court, please write to us: we will try to solve the issue together.
This is the form in Annex I, Part B, of the Italian Consumer Code (Legislative Decree 206/2005). You can copy it into an email to battuta.campoli@gmail.com; using it is not mandatory (see section 5).
